BLD.Market Terms of Use Agreement
This Terms of Use Agreement (“”Agreement””) governs your use of the BLD.Market platform (“”Platform””). By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use the Platform.
1. Acceptance of Terms
By creating an account on BLD.Market (“”Platform””), you (“”User””) agree to comply with and be bound by the following terms of use. If you do not agree to these terms, you must not use the Platform.
2. User Eligibility
Users must be at least 18 years old and legally capable of entering into binding contracts. By using the Platform, you represent that you meet these eligibility requirements.
3. Account Registration
To access the Platform, Users must create an account by providing accurate and complete information. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
4. Use of the Platform
The Platform is intended to connect property owners with project leads and contractors for the management of renovation and construction projects. All Users agree to use the Platform solely for its intended purpose and in compliance with all applicable laws and regulations.
5. Project Engagement and Escrow
a. Deposits: Property owners (“”Project Owners””) will deposit funds into an escrow account on the Platform upon agreeing to terms with a project lead or contractor.
b. Escrow Management: The Platform will hold funds in escrow until the project is completed to the satisfaction of the Project Owner, at which point payment will be released to the project lead or contractor less any applicable platform fees.
c. Disputes: In the event of a dispute between a Project Owner and a project lead or contractor, the Platform may hold funds in escrow until the dispute is resolved.
6. Fees
The Platform will charge a fee for services rendered, which will be deducted from the payment made to project leads and contractors upon completion of the project. Users agree to pay all applicable fees and understand that these fees are non-refundable.
7. User Conduct
Users agree not to:
Engage in any fraudulent or deceptive practices.
Misuse the Platform for unlawful purposes.
Infringe on the intellectual property rights of others.
Post or transmit any harmful, offensive or inappropriate content.
8. Intellectual Property
All content, trademarks and data on the Platform are the property of BLD.Market or its licensors. Users may not copy, distribute or otherwise use any part of the Platform’s content without prior written permission.
9. Privacy
Users agree to the Platform’s Privacy Policy, which governs the collection, use and disclosure of personal information provided by Users.
10. Limitation of Liability
The Platform provides a marketplace for Users but does not guarantee the quality, safety or legality of the services offered. Users agree that BLD.Market will not be liable for any damages or losses arising from their use of the Platform.
11. Termination
The Platform reserves the right to terminate or suspend a User’s account at its sole discretion for any violation of these terms or for other reasons deemed necessary to protect the Platform and its Users.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
13. Amendments
BLD.Market reserves the right to modify these terms at any time. Users will be notified of significant changes and continued use of the Platform constitutes acceptance of the new terms.
14. Platform Circumvention and Liability
a. Prohibition on Circumvention: Users are strictly prohibited from circumventing the Platform by initiating, soliciting or completing payments outside of the Platform for services that were first introduced or facilitated through the Platform.
b. Liability for Circumvention: If a User is found to have circumvented the Platform, they will be liable for any lost fees and may be subject to account suspension or termination. Additionally, the Platform reserves the right to seek legal remedies, including but not limited to, claiming damages, recovering fees and enforcing contractual obligations.
c. Reporting Circumvention: Users are encouraged to report any suspected circumvention activities. The Platform will take necessary action to investigate and, if needed, rectify the situation.
